Sistem Konstitusional.
Indonesia merupakan negara yang berdasarkan atas hukum (rechtsstaat).
Kekuasaan tertinggi negara ada di tangan MPR (Majelis Permusyawaratan Rakyat).
Kekuasaan kepala negara tidak tak terbatas.
Presiden tidak bertanggung jawab kepada Dewan Perwakilan Rakyat.
Presiden merupakan penyelenggara pemerintah negara yang tertinggi dibawah MPR (Majelis Permusyawaratan Rakyat)
Menteri negara adalah pembantu presiden, menteri negara tidak bertanggung jawab kepada DPR (Dewan Perwakilan Rakyat).
Dari tujuh kunci pokok sistem pemerintahan diatas, sistem pemerintahan Indonesia menurut UUD 1945 menganut sistem pemerintahan Presidensial. Sistem pemerintahan Presidensial ini dijalankan semasa pemerintahan Orde Baru.
Ciri dari sistem pemerintahan Presidensial kala itu ialah adanya kekuasaan yang sangat besar pada lembaga kepresidenan. Hampir semua kewenangan presiden yang di atur menurut UUD 1945 tersebut dilakukan tanpa melibatkan persetujuan maupun pertimbangan DPR sebagai wakil rakyat. Karena tidak adanya pengawasan dan persetujuan DPR, maka kekuasaan presiden sangat besar dan cenderung mudah disalahgunakan. Mekipun adanya kelemahan, kekuasaan yang besar pada presiden juga ada dampak positifnya yaitu presiden dapat mengendalikan seluruh penyelenggaraan pemerintahan sehingga mampu menciptakan pemerintahan yang solid dan kompak serta Sistem pemerintahan lebih stabil, tidak mudah jatuh atau berganti. Namun, dalam praktik perjalanan sistem pemerintahan di Indonesia pada masa itu ternyata kekuasaan yang besar dalam diri presiden lebih banyak merugikan bangsa dan negara daripada keuntungan yang didapatkan.

Memasuki masa Reformasi, bangsa Indonesia bertekad untuk menciptakan sistem pemerintahan yang lebih baik (demokratis). Untuk itu, harus disusun pemerintahan yang berdasarkan pada konstitusi (Pemerintah konstitusional). Pemerintah konstitusional memiliki ciri bahwa konstitusi negara itu berisi :
Jaminan terhadap hak asasi manusia dan hak-hak warga negara.
Adanya pembatasan kekuasaan pemerintahan atau eksekutif.
Sistem pemerintahan Indonesia Berdasarkan UUD 1945 Setelah Diamandemen
Salah satu tuntutan Reformasi 1998 ialah dilakukannya amandemen pada UUD 1945. Latar belakang tuntutan perubahan UUD 1945 antara lain karena pada masa Orde Baru, kekuasaan tertinggi di tangan MPR (namun kenyataannya bukan di tangan rakyat), kekuasaan yang sangat besar pada Presiden, adanya pasal-pasal yang terlalu "luwes" (yang dapat menimbulkan mulitafsir), serta kenyataan rumusan UUD 1945 tentang semangat penyelenggara negara yang belum cukup didukung ketentuan konstitusi.
Tujuan perubahan UUD 1945 waktu itu ialah menyempurnakan aturan dasar seperti tatanan negara, HAM, kedaulatan rakyat, pembagian kekuasaan, eksistensi negara hukum dan negara demokrasi, serta hal-hal lain yang sesuai dengan perkembangan aspirasi dan kebutuhan bangsa. Perubahan UUD 1945 dengan kesepakatan diantaranya tidak mengubah Pembukaan UUD 1945, tetap mempertahankan susunan kenegaraan (staat structur) kesatuan atau selanjutnya lebih dikenal sebagai Negara Kesatuan Republik Indonesia (NKRI), serta mempertegas sistem pemerintahan presidensil.
Sistem ketatanegaraan Indonesia sesudah Amandemen UUD 1945, dapat dijelaskan sebagai berikut: Undang-Undang Dasar merupakan hukum tertinggi dimana kedaulatan berada di tangan rakyat dan dijalankan sepenuhnya berdasarkan UUD. UUD memberikan pembagian kekuasaan (separation of power) kepada 6 lembaga negara dengan kedudukan yang sama dan sejajar, yaitu Majelis Permusyawaratan Rakyat (MPR), Presiden, Mahkamah Agung (MA), Dewan Perwakilan Daerah (DPD), Mahkamah Konstitusi (MK), Badan Pemeriksa Keuangan (BPK), serta Dewan Perwakilan Rakyat (DPR).

Pada masa sekarang ini, bisa disebut sistem pemerintahan di Indonesia masih dalam masa transisi. Sebelum diberlakukannya sistem pemerintahan baru berdasarkan UUD 1945 hasil amandemen ke 4 tahun 2002, sistem pemerintahan Indonesia masih mendasarkan pada UUD 1945 dengan beberapa perubahan seiring dengan adanya transisi menuju sistem pemerintahan yang baru. Sistem pemerintahan yang baru ini diharapkan berjalan mulai tahun 2004 setelah dilakukannya Pemilu pada tahun 2004.
Pokok-pokok sistem pemerintahan Indonesia adalah sebagai berikut:
Bentuk pemerintahan adalah republik, sedangkan sistem pemerintahan presidensial.
Bentuk negara kesatuan yang memiliki prinsip otonomi daerah yang luas. Wilayah negara terbagi menjadi beberapa provinsi.
Kekuasaan yudikatif dijalankan oleh Makamah Agung dan badan peradilan dibawahnya.
Presiden merupakan kepala negara yang sekaligus sebagai kepala pemerintahan. Presiden dan wakil presiden dipilih secara langsung oleh rakyat dalam satu paket.
Parlemen terdiri dari dua bagian (bikameral), Dewan Perwakilan Daerah (DPD) dan Dewan Perwakilan Rakyat (DPR). Para anggota DPR dan DPD merupakan anggota MPR. DPR mempunyai kekuasaan legislatif serta kekuasaan mengawasi jalannya pemerintahan.
Kabinet / menteri diangkat oleh presiden serta bertanggung jawab langsung kepada presiden.
Sistem pemerintahan ini juga mengambil elemen-elemen dari sistem pemerintahan parlementer dan melakukan pembaharuan untuk menghilangkan kelemahan yang ada pada sistem presidensial. Beberapa variasi sistem pemerintahan presidensial di Indonesia ialah sebagai berikut :
Presiden dalam mengeluarkan kebijakan tertentu perlu pertimbangan atau persetujuan dari DPR.
Parlemen mendapat kekuasaan yang lebih besar dalam hal membentuk undang-undang dan hak anggaran (budget)
Presiden sewaktu-waktu bisa diberhentikan oleh MPR atas usul dari DPR. Jadi, DPR tetap memiliki kekuasaan mengawasi presiden meskipun tidak secara langsung.
Presiden dalam mengangkat penjabat negara perlu persetujuan dan pertimbangan DPR.
Sistem Pemerintahan Indonesia Saat Ini (Setelah Diamandemen)
Berdasarkan Pembukaan UUD 1945 Alinea IV yang berbunyi, "bahwa kemerdekaan kebangsaan Indonesia itu disusun dalam suatu Undang-Undang Dasar Negara Indonesia yang terbentuk dalam suatu susunan negara Republik Indonesia yang berkedaulatan rakyat".
Berdasarkan Pasal 1 Ayat 1 UUD 1945, yang berbunyi, "Negara Indonesia adalah negara kesatuan yang berbentuk republik".
Dapat disimpulkan bahwa bentuk negara Indonesia ialah Negara Kesatuan, sedangkan bentuk pemerintahannya ialah Republik. Selain bentuk pemerintahan republik dan bentuk negara kesatuan, Presiden Republik Indonesia memegang kekuasaan sebagai kepala negara dan sekaligus kepala pemerintahan. Hal itu didasarkan pada Pasal 4 Ayat 1 yang berbunyi, "Presiden Republik Indonesia memegang kekuasaan pemerintahan menurut Undang Undang Dasar". Dengan demikian, sistem pemerintahan di Indonesia menganut Sistem Pemerintahan Presidensial.

Secara teori, berdasarkan UUD 1945, Indonesia menganut sistem pemerintahan presidensial. Namun dalam praktiknya banyak elemen elemen dari sistem pemerintahan parlementer yang masuk ke dalam sistem pemerintahan di Indonesia.
